PROHIBITED SITE USE POLICY

Effective Date: August 9, 2016

To ensure that we maintain a safe and trusted marketplace, LootPost.com and all its related and affiliated websites (“LootPost”) and to avoid the use of LootPost for unauthorized or unintended purposes, we require you and all other users of LootPost (each, a “User”) to agree and to comply with these Prohibited Site Use Policy (the “Policy”). The Policy set forth the acceptable and prohibited uses of LootPost and are in addition to the other Terms of Service. By accessing LootPost, or any of LootPost Services after the effective date, you agree to this Policy. You are also independently responsible for complying with all acceptable laws to your use of LootPost or the LootPost Services whether or not they are covered by this Policy.

Scope of the Policy

The uses described in this Policy are prohibited regardless on where on LootPost they occur. These activities include, but are not limited to, posting of questions, proposals, message exchange between Users and/or LootPost research writers (the “LootPost Scout”), communications with customer service or disputes, and User or LootPost Scout feedback.

Illegal, harmful, fraudulent or offensive use.

You many not use, encourage, promote, facilitate, instruct or induce others to use LootPost and LootPost Services for any activities that (i) violate any law, statute, ordinance or regulation; (ii) for any illegal, harmful or offensive purpose or (iii) to transmit, store, display, distribute, or otherwise make available content that is illegal, harmful or offensive.

These prohibited uses of LootPost or LootPost Services include, but are not limited to:

  • Seeking, offering, or endorsing illegal, obscene, or pornographic services or activities, including services (i) that would violate the intellectual property rights, including copyrights, of another person, entity, service, product or website or (ii) that would the creation, review, or editing of pornographic, erotic, obscene or sexually explicit material;
  • Posting content that is offensive, defamatory, profane, vulgar, obscene, threatening, discriminatory, illegal, pornographic or sexually implicit in nature;
  • Seeking, offering or endorsing any services that would violate LootPost’s Terms of Service of the terms of service of another website or any other contractual obligations;
  • Seeking, offering or endorsing any services that violate the academic policies of any educational institution;
  • Expressing a preference in a job post, proposal or otherwise unlawfully discriminating on the basis of race, religion, color, national origin, ancestry, physical or mental disability, medical condition, genetic information, marital status, sex, gender, gender identity, gender expression, age, sexual orientation, military/veteran status or any other such basis as protected by applicable laws;
  • Posting content that is directly, indirectly or subjectively harassing towards another person that violates the rights of the third party;
  • Seeking, offering, endorsing or posting content containing identifying information concerning another person or entity;
  • Spamming other Users;
  • Using any robot, spider, scraper, or other automated means to access LootPost for collecting, harvesting or any other related activity personal identifiable information of LootPost’s Users including Account names, contact numbers, addresses, and other such identification information without LootPost’s prior written consent;
  • Fraudulently billing or attempting to fraudulently bill any User by (i) falsifying, manipulating hours and other billable information recorded by LootPost, (ii) attempting to falsify or manipulate hours and other billable information recorded by LootPost, (iii) reporting, recording or otherwise billing work done by another person as work completed by you in a way that is misleading or false, or (iv) any other activities not mentioned here that would directly or indirectly result to fradulently billing LootPost’s Users;
  • Making or demanding bribes from LootPost Users, employees, and/or its authorized representatives;
  • Making or demanding payments without the intention of providing or receiving services in exchange for the payment;
  • Engaging in any conduct that directly, indirectly or subjectively likely to cause any form of harm to LootPost and its Users including, but not limited to (i) imposing an unreasonable or disproportionately large load (based on LootPost’s sole discretion) on LootPost’s infrastructure, (ii) interfering or attempting to interfere with the proper operation of LootPost or LootPost Services or any activities conducted on LootPost, (iii) bypassing any measures LootPost uses in the present and future to prevent and/or restrict access to LootPost, entirely or in part, its related and affiliated websites, including, but not limited to features that prevent and/or restrict the use or copying of any content or enforce limitations on the use of LootPost and/or its content within, or (iv) attempting to interfere with and/or compromise LootPost’s system’s integrity or security or decipher any transmissions to or from the servers running LootPost.

Use other than its intended purpose.

LootPost and LootPost Services are available for Users and LootPost Scouts to find one another, enter into service relationships, make and receive payments through PayPal, and receive and perform LootPost Scout Services. Users are expected to use LootPost and LootPost Services for their intended purpose and not in contravention or contradiction of their intended purposes. These activities include, but are not limited to:

  • Offering services to Users for the sole purpose of obtaining positive feedback of any kind;
  • Seeking, requesting, demanding, suggesting or receiving free services, including but not limited to requesting LootPost Scouts to submit work for very little or no money or posting requests in which LootPost Scouts submit work with no or very little pay in the form of a contest with only the winning submission is paid the full amount;
  • Posting the same question onto LootPost multiple times so that more than one version remains active at any given time;
  • Withholding payment, work product or engaging in any other similar or related conduct for the purpose of obtaining positive feedback from a User;
  • Attempting to falsify, manipulate or coerce a LootPost Scout by threatening to give a negative feedback;
  • Misusing the feedback feature to express views unrelated to the work completed by the LootPost Scout including, but not limited to political, religious, gender, and/or social commentaries;
  • Duplicating or sharing accounts;
  • Selling, trading or giving an account to another person without the prior written consent of LootPost;
  • Sharing or soliciting contact information such as e-mail addresses, phone numbers, or Skype IDs in a User profile or job post;
  • Soliciting or processing payment outside of PayPal in violation of the Terms of Service;
  • Advertising products or services that are beyond or outside the scope of LootPost’s marketplace; and
  • Advertising on LootPost to recruit LootPost Scouts to join an agency or website similar in whole or part to LootPost.

Posting of false or misleading content

All profiles, jobs, proposals and other content posted to LootPost must be truthful and not misleading.  Information that is considered to be in violation of this Policy includes, but not limited to:

  • Misrepresenting a LootPost Scout’s experience, skills or information;
  • Impersonating any person or entity including, but not limited to, a LootPost representative, forum leader, guide or host;
  • Falsely stating or otherwise misrepresenting your affiliation with a person or entity within or outside LootPost;
  • Falsely attributing statements to any LootPost representative, leader, guide or host;
  • Allowing another person to use your Account;
  • Falsely stating or implying directly or indirectly having any form of relationship with LootPost and/or its representatives, or with another company and/or its representatives with whom you do not have a relationship;
  • Falsely stating or implying directly or indirectly having any form of relationship with another User, including but not limited to an Agency continuing to use a LootPost Scout’s profile and/or information after the LootPost Scout is no longer associated or working with LootPost; and
  • Falsely stating that one LootPost Scout will perform the work on a job when another will in fact perform the work, including but not limited to submitting partial or completed work on behalf of the LootPost Scout that is unavailable, unwilling, or unavailable to do the work.

Enforcement of the Policy

LootPost reserves the right, but do not assume the obligation, to investigate the violation of any part of this Policy. LootPost may investigate violations and may remove, disable access to, and/or modify any content that violates this Policy.

LootPost may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. LootPost’s reporting may include disclosing appropriate User informtion. LootPost may also cooperate with appropriate law enforcement agencies, regulators and/or other appropriate third parties to aid with the investigation and prosecution of any illegal conduct by providing network and systems information related to alleged violations of this Policy.

Reporting of violations of this Policy

Users must immediately report any violation of this Policy committed by another or by a LootPost Scout to LootPost via e-mail at info@lootpost.com or through telephone at 646.807.9343.

By reporting any violation of this Policy, you agree to assist LootPost with any investigation we undertake and to take any remedial steps we require in order to correct any and all violation of this Policy.
